Subject: RE: Auxiliary Fuel Tanks - Notice of Proposed Rulemaking

Anyhony,

Thanks for your quick reply. I know PATS are in the middle of clearing this

issue, but to make my life easier can you please answer these few questions?

1. Is the kit/SB we have now going to cover us for everything FAA and Boeing

has written until now including 2007-NM-316-AD and MOM 1-788871861-1? The SB's comply with the current conditions stipulated by the FAA. Keep in mind the PATS SBs only pertain to the aux fuel system. The aircraft (737) system still falls under Boeing.

2. If not will we bee able to have the changes done before we are due to

finish this maintenance input 28th April 2008? Please refer to question 1.

3. If we will not be able to do these latest changes on this input, can we

wait until April 2009? Your aircraft will be compliant unless the FAA issues additional requirements. Keep in mind, the SB’s currently in work have already been approved by the FAA.

4. If we can not wait until April 2009, how much work will have to be done? Not Applicable at this time.

Could you send some technician e.g. to Milan to meet the aircraft and how

long time would you need to work on the aircraft? If the FAA mandated a change to the already approved SB, I’m sure either Jet or PATS could accommodate the situation.

5. Will there be additional cost? Cost would only apply if the FAA were to increase or modify the existing approved document.

Kind regards,

Good Day,

Let me start by saying the wording in the NPRM is slightly misleading.

We are currently putting together a service letter outlining the NPRM

and PATS position with respect to the FAA mandate. Our letter should

help clear up a lot of operators questions.

The service bulletins presently under way will not necessitate further

removal of the tanks. The SB's are FAA approved; the PATS system will be

compliant upon completion of both BBJ service bulletins (SB-001 and

SB-021).

Hi David

I spoke with the guys from PATS that are working on our aircraft right

now.

They have been told by Anthony Spagnoletti, SFAR88, Program Manager at

PATS that MOM 1-788871861-1 is only a reminder of what is already know,

that the kit we have is OK and that the tanks do not need to come out

again.

Can Boeing confirm this?

Hi Anthony

Can you confirm what I have just written to David?

Peter,

Have you been in contact with Pats about getting their SFAR 88 SBs for

your  airplane? I have no access to who they have been talking to about

this. The tanks will need to come out again to make some changes to the

master tanks. Jet is an authorized supplier for this work (Pats

authorized) so I would advise you to talk to Michael Sattler about what

the work required is and when you can get a kit.

As of right now I do not know very much because this came out on a

Friday afternoon and no one from Seattle has told me anything.

I am sure we will be sending out something but your best source of

information is Pats and Jet on this issue.

David,

What does this mean? What conditioning is that they are talking about

and is that something we can have corrected before our tanks are done?

We would not appreciate if the tanks need to come out again. And I might

get problems because of this.

/A/  2007-NM-316-AD

Summary:

The following is a notification of ref /A/ Notice of Proposed Rulemaking

(NPRM).  The FAA proposes to adopt a new airworthiness directive (AD)

for various transport category airplanes. This proposed AD would require

deactivation of PATS Aircraft, LLC, auxiliary fuel tanks. This proposed

AD results from fuel system reviews conducted by the manufacturer, which

identified potential unsafe conditions for which the manufacturer has

not provided corrective actions. The FAA is proposing this AD to prevent

the potential of ignition sources inside fuel tanks, which, in

combination with flammable fuel vapors, could result in fuel tank

explosions and consequent loss of the airplane.

Comments must be received by the FAA by April 28, 2008.
